Please read these conditions carefully
The present General Conditions of Use, Conditions of Sale and Privacy Policy, regulate the use of the website, “www.globalfood.market”, of which HILL FOODS EUROPE SL. is the owner.
HILL FOODS EUROPE SL, (hereinafter GLOBALFOOD.MAKET) is a Spanish limited liability company with registered office at Carrer Brosquill, 16, 46540 El Puig de Santa Maria Valencia, Spain. It is registered in the Mercantile Register of Valencia, in Volume 10187, book 7469, folio 52, page V-172953, Incrip 6. with CIF number B-98863467.
These Conditions establish the rights and obligations of all users of GLOBAL FOOD, in relation to the products and services offered through our website “www.globalfood.market”, (hereinafter the “Store”).
1. User Obligations.
1.1 The User agrees, in general, to use the Store, to purchase the Products and to use each of the services of the Store diligently, in accordance with the law, morality, public order and the provisions of these General Conditions, and must also refrain from using them in any way that may prevent, damage or impair the normal operation and enjoyment of the Store by the Users or that could damage or cause damage to the property and rights of GLOBALFOOD.MARKET, its suppliers, Users or in general any third party.
2. Products and Services.
2.1 GLOBAL FOOD reserves the right to decide, at any time, the Products offered to the Users through the Store. In particular, GLOBALFOOD.MARKET may at any time add new Products to those offered or included in the Store, being understood that unless otherwise provided, such new Products shall be governed by the provisions of these General Conditions. Likewise, GLOBALFOOD.MARKET reserves the right to stop providing or facilitating the access and use at any time and without prior notice of any of the different types of Products offered in the Store.
2.2 The Products included in the Store shall correspond as closely as possible that the web display technology allows to the Products actually offered. The prices indicated in the Shop are in Euros and include VAT, unless otherwise indicated.
2.3 This merchant agrees not to permit any transaction that is illegal, or is deemed by the credit card brands or the acquiring bank, that may or has the potential to damage the goodwill of, or negatively influence them. The following activities are prohibited under the card brands’ programs: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Purchaser, Issuing Bank, Merchant, Cardholder, or cards. GLOBALFOOD.MAKET reserves the right to cancel or refuse any order from a User-Customer with whom it has a dispute regarding payment of a previous order.
Furthermore it is also explicitly forbidden to sell alcoholic beverages to persons under 18 years of age.
2.4 The orders placed on the Internet through www.globalfood.market involve contractual data between the User-Customer and the store which will be confirmed and collected by both parties before shipment.
2.5 GLOBALFOOD.MARKET commits itself to accept orders according to the terms of the general conditions of sale here exposed. The User-Customer declares to know and accept the present general conditions of sale before confirming his orders. Confirmation of an order therefore implies acceptance of these General Conditions of Sale. Unless proven otherwise, the data registered by the store constitute a proof of the whole of the transactions carried out between GLOBALFOOD.MARKET and its customers.
3. Procedure and Method of Payment of the Products.
3.1 Within twenty four (24) hours, GLOBALFOOD.MARKET will send an email to the User, confirming the purchase. This email will assign a reference code of the purchase, and will detail the characteristics of the Product, its price, the shipping costs and the details of the different options to make the payment of the Products to GLOBALFOOD.MARKET.
3.2 The User that purchases a product through the Store must make the payment through the payment systems specifically detailed in the Store.
3.3 GLOBAL FOOD will file the electronic documents in which the contract is formalized, sending a copy to the User once the purchase is done. The contract will be made in the Spanish language.
3.4 The order confirmation sent by GLOBALFOOD.MARKET is not valid as invoice, only as proof of purchase. The user will be able to download the invoice from his account or request a company invoice. The user can also ask for it to be sent by e-mail.
4. Return policy.
Special cases
1. In the purchase of footwear and clothing, an exchange of size may be made at no cost to the customer provided that it has not been used and is in the same condition as it arrived. It must contain the original packaging.
2. In the event that the customer rejects the merchandise once here will be refunded the amount of the products. GLOBAL FOOD reserves the right to charge the return costs to the customer.
3. Products for intimate use do not accept exchanges and/or returns as indicated in article 103 of Law 3/2014, of March 27.
4. Returns of fresh and/or refrigerated food products (fruit, vegetables, meats, dairy, vegan products …) as well as living beings (plants, worms) are not accepted.
5. We do not accept returns of products that require installation and which have already been installed.
5. Customer Service.
5.1 For any incident, claim or exercise of their rights, the User may send an email to the address [email protected] or call 961 154 111.
6. Home Delivery Service.
6.1 The territorial scope of sales through the Store is exclusively for the areas indicated on the page, so the delivery service will only be for that territory. Products purchased through the Store will be shipped to the delivery address indicated by the User once payment has been verified (except for cash on delivery), with the maximum delivery time being thirty (30) days established by default in the Law unless otherwise specified at the time of purchase.
Shipments are delivered to the address indicated by the user in the purchase process. Shipments to PO Boxes are not allowed. If the order is large or heavy, the carrier will deliver to the doorway or, failing that, the lowest floor. The fact that an additional “weight surcharge” is charged does not imply that it will be delivered to the address if it is bulky. It is simply a special charge for transporting it.
6.2 The cost of shipping is not included in the price of the Products. At the time of purchase of the Product, the User will be informed of the exact cost of shipping and other additional costs that may arise.
7. Intellectual and Industrial Property.
7.1 The User acknowledges that all the elements of the Store and of each one of the Products, the information and materials contained therein, the trademarks, the structure, selection, arrangement and presentation of its contents, and the computer programs used in connection therewith, are protected by intellectual and industrial property rights of GLOBALFOOD.MARKET itself or of third parties, and that the General Conditions do not attribute any other right with respect to such industrial and intellectual property rights other than those specifically contemplated therein.
7.2 Unless authorized by GLOBALFOOD.MARKET or in its case by the third parties owners of the corresponding rights, or unless it is legally permitted, the User shall not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend, make available, or allow access to the public through any form of public communication of any of the elements referred to in the previous paragraph. The User shall use the materials, elements and information accessed through the use of the Store only for their own needs, agreeing not to make any direct or indirect commercial exploitation of the materials, elements and information obtained through the same.
7.3 The User shall refrain from circumventing or manipulating any technical devices established by GLOBALFOOD.MAKET or third parties in the Store.
8. Data Protection.
In order to guarantee and protect the privacy and confidentiality of the personal data of the users of our website and in order to protect their intimacy and privacy, we have drafted, in accordance with current legislation, the Privacy Policy.
The terms contained therein and especially the duty of confidentiality will be mandatory for all internal or external staff who work or may work with us and have access to the data you provide, either while browsing our website, by using our forms or during the recruitment or provision of services.
We reserve the right to modify the content of this Privacy Policy, in order to adapt it to new legislation or jurisprudence, as well as reports or opinions issued by the Spanish Data Protection Agency or the Article 29 Working Group.
In the event that we are going to use the personal data of Users, Potential Clients or Clients, in a manner different from that established in the Privacy Policy in force at the time you provide us with the data; or in the event that we are going to treat them for purposes other than those indicated at the time you provide us with your data, we will make every effort to contact you as affected, to inform you and obtain your consent again. Otherwise, we will not use the data for different purposes.
We advise Users to review the present text each time they access our website to make sure of the purposes and uses we can make of their data.
The Privacy Policy will be part of and will be permanently linked to the provisions of our Legal Notice, the Legal Conditions of the contracted service and our Cookies Policy.
At all times we will indicate the date of the last update of the Privacy Policy so that users know the effective content that applies to them and the date of the last revision.
HILL FOODS EUROPE, S.L. notes that this Privacy Policy is adapted to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter GDPR).
9. Passwords.
9.1 GLOBALFOOD.MARKET will facilitate the use of personal passwords to the user who registers as such on the Website. These passwords will be used for the access to the services provided through the Web Site. The user must keep the passwords under his sole responsibility in the strictest and absolute confidentiality, assuming, therefore, any damages or consequences of any kind arising from the breach or disclosure of the secret. For security reasons, the password for telematic access to the services linked to the Website may be modified at any time by the user. The User undertakes to notify GLOBALFOOD.MARKET immediately of any unauthorized use of its password, as well as the access by unauthorized third parties to it.
10. Cookies.
10.1 GLOBALFOOD.MARKET uses cookies in order to improve its services, facilitate navigation, maintain security, verify the identity of the User, facilitate access to personal preferences and track your use of the Store. Cookies are files installed on the hard drive of the computer or in the memory of the browser in the folder preconfigured by the operating system of the User’s computer to identify you.
10.2 If the User does not want a cookie to be installed on his or her hard drive, he or she must configure his or her Internet browser not to receive them. Likewise, the User may freely destroy cookies. If the User decides to disable cookies, the quality and speed of service may decrease and even lose access to some of the services offered in the Store.
11. Dispute Resolution
EUROPEAN PLATFORM FOR THE RESOLUTION OF E-COMMERCE DISPUTES.
We inform consumers that the Online Dispute Resolution Platform (“ODR Platform”) is operational for all European Union countries, including Spain.
In the case of Spain, the European Commission has designated the European Consumer Center attached to the Spanish Agency for Consumer Affairs, Food Safety and Nutrition, as the platform’s contact point, to assist and support the submission of complaints through the platform.
As of the entry into force of Directive 2013/11/EU of the European Parliament and of the Council of 21 May 2013 on alternative dispute resolution in consumer matters and Regulation 524/2013 of the European Parliament and of the Council, we are obliged to inform about the existence of the platform to our buyers. Hence, we inform our Users that in case of any dispute with the consumer of GLOBALFOOD.MARKET, there is a new European, simple, multilingual and accessible procedure for the resolution of the same.Which consists of the following:
The consumer must access this platform and complete the online complaint form. Once completed, the form will be sent from the same platform. The claim will be sent to GLOBALFOOD.MARKET, who will propose to the consumer an alternative dispute resolution entity. Once the consumer and the seller agree on the mediation entity that will resolve their conflict, the platform will send the claim to the chosen entity.
The mediation entity will deal with the case electronically and propose a solution within 90 days at the latest.”
12. Curriculum
For the purposes of the provisions of the current legislation on data protection, the data of your curriculum that you provide us, are essential for the processing of the application and, its owners consent that their personal data and curriculum, including the email address, which are provided are incorporated into the file for which GLOBALFOOD.MARKET is responsible, in order to study and/or execute the present application and for the study and personalized or segmented analysis of the same. The personal data provided will be used with the purpose, in the way and with the limitations and rights granted by the Organic Law 15/1999, of Personal Data Protection. The holder may freely exercise the rights of opposition, access and information, rectification, cancellation of their data and revocation of their authorization without retroactive effect, acting as indicated in this section.
